Welcome to autoshowplus.ca and related mobile application (the “Website”). This Website and application are operated by Canadian International AutoShow (“we”, “our”, “us” or “CIAS”)
Any person who wants to use the Website or application (referred to herein as “you” or “your”) must accept these terms and conditions of use (“Terms of Use”). Please read them carefully. By using and accessing this Website or application, you accept, without limitation, all the Terms of Use, and all related policies of the Website or application, including the Privacy Policy (as defined below), as indicated in these Terms of Use. If you do not agree with all these Terms of Use, you must not access or use the Website and application.
By accessing the Website or application, you acknowledge that you have seen, reviewed and understand the Website and applications privacy policy ("Privacy Policy") governing the collection, use, storage, and disclosure of your Personal Information. You agree to be bound by the Privacy Policy while you are using the Website or application. You also agree that the terms of the Privacy Policy are reasonable. The Privacy Policy may be modified by CIAS from time to time at its sole discretion and your continued use of the Website or application after such modification will constitute your acceptance of such modifications.
Purpose of the Site
The purpose of this Website and application is a) to provide you with general information, news and updates about our products and services and b) to offer a platform for user engagement and conversation about these topics.
By accessing this Website or application, you represent, warrant and agree that you are of the age of majority in your province of residence, or have received approval from your legal guardian who is the age of majority in your province of residence .

When you first log in on the Website or application, you will be asked to fill in your profile on the Website/Application as part of your registration. You understand that you have no proprietary rights in the Third Party Content and that the third parties retain all proprietary rights, title or interest, including copyright, in their respective Third Party Content. You may not copy, sell, reproduce, distribute, retransmit, publish, modify, display, prepare derivative works based on, re-post or otherwise use any of the Third-Party Content without the prior written consent of such third parties. You may not use any meta-tags or any other “hidden text” utilizing our name, the Trademarks or the Third Party Marks without the express written consent of CIAS.
4. Lawful Use of Website/Application
You agree that you shall use the Website/Application for lawful purposes only. The Website/Application may contain comment boxes, forums, chat areas and/or other message or communication facilities designed to allow you to communicate with other users of the Website/Application. You agree only to post and send messages and content that are proper and related to the relevant area of the Website/Application.
Without limiting the generality of the foregoing, you will not use the Website/Application, or allow others to use the Website/Application, to:
i. download, e-mail, post, make available, provide access to, or otherwise transmit any material that is unlawful or criminal, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, pornographic, hateful, or racially, ethnically or otherwise objectionable, including but not limited to any materials which encourage conduct that would constitute a criminal offence or civil liability, infringe other’s intellectual property or other rights, disclose private or personal matters concerning any person, or otherwise violate or may be considered to violate any applicable local, provincial, federal or international law;
ii. e-mail, post, make available, provide access to, or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation;
iii. upload, e-mail, post, make available, provide access to, or otherwise transmit on the Website/Application any material that contains software viruses, worms, “Trojan Horses”, or any other computer code, files or programs designed to interrupt, destroy, alter, or limit the functionality of any computer software or hardware or telecommunications equipment;
iv. interfere with or disrupt the Website/Application or servers or networks connected to the Website/Application, including attempting to interfere with the access of any other user, host or network, including without limitation, overloading, engaging in “denial of service” attacks, “spamming”, “crashing”, or “mail-bombing” the Website/Application or disobeying any requirements, procedures, policies or regulations of networks connected to the Website/Application;
v. use the Website/Application for any public or commercial purposes, including the solicitation of funds, without CIAS’ prior written permission;
vi. modify, adapt, sublicense, translate, sell, reverse engineer, decompile, disassemble, mirror, scrape, data-mine, attempt to extract the source code of or otherwise deconstruct any portion of the Website/Application or Website/Application Content; or'
vii. collect or store personal data about other users.
You agree not to access the Website/Application from any territory where its use or content is illegal. You agree that CIAS is not responsible for compliance with applicable foreign local laws.
CIAS reserves the right to monitor use of the Website/Application to determine compliance with these Terms of Use, as well as the right to remove or refuse any information which violates these Terms of Use. CIAS also always reserves the right to disclose any information as necessary to satisfy any applicable law, regulation, legal process, or governmental request.
You are responsible for violations of these Terms of Use by anyone using the Website/Application with your permission or using your account. Your use of the Website/Application to assist another person in an activity that would violate these Terms of Use if performed by you is a violation of these Terms of Use.
The Website/Application is only intended for use by persons located in Canada. The Website/Application is not intended for use in any other jurisdiction, nor where its use is prohibited. If you access the Website/Application from outside Canada, you do so at your own risk and you are responsible for compliance with local laws of your jurisdiction(s).
User-Created Content
By uploading any content created by yourself, or by others using your account, to the Website/Application (“User-Created Content”) as part of your usage of the website/application, you hereby understand and grant permission to CIAS, its affiliates, licensed operators, and all successors and assignees (collectively the “Releasees”), to use the User-Created Content, including your name, image and/or likeness as such name, image and/or likeness may appear in various places on the Website/Application. You acknowledge that CIAS will not use your image or information outside of the Website/Application, without your written permission, except as described in the Privacy Policy and in accordance with applicable laws.
You agree that you shall receive no compensation or payment whatsoever with respect to any materials or User Created Content you have uploaded to the website/application, including your name, image and/or likeness. If CIAS administers a contest using User Created Content, such contest will be operated under separate contest terms and any prizes awarded for participation in such contest shall be subject to those specific contest terms.
You confirm that CIAS’ use of User Created Content provided by you shall not violate or infringe any rights of any third party or otherwise be unlawful or inappropriate. You hereby release the Releasees from all claims and demands arising out of or in connection with such use of the Website/Application, including, without limitation, all claims for invasion of privacy, infringement, copyright, defamation (including libel and slander), false light and any other personal and/or property rights. You acknowledge and agree that Releasees shall own all right, title, and interest, including the copyright, in and to the Website/Application and associated materials, to be used and disposed of, without limitation as CIAS shall determine in its sole discretion.
- Modifications to the Website/Application
CIAS reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, any part of the Website/Application and to restrict or prohibit access to it, with or without notice. You agree that we shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Website/Application. We reserve the right, in our sole discretion, to correct any errors or omissions in any portion of this Website/Application at any time without notice but confirms that we have no obligation to do so.

You hereby agree to release CIAS and its affiliates and subsidiaries and their respective directors, officers, shareholders, employees, agents, representatives or advisors (“Representatives”) from any and all liability whatsoever or arising from your use of the Website/Application, including any e-mail to the Website/Application, and you agree that if you are unhappy with any of the services provided through the Website/Application, then your sole remedy is to cease using them.
You hereby agree that CIAS does not guarantee that products displayed on the site are available at time of ordering and that there is no guaranteed level of service or performance associated with the Website/Application.
- Limitation of Liability
In no event shall CIAS, or its affiliates or subsidiaries or their respective Representatives be liable to you for any direct, indirect, incidental, special, consequential, punitive or exemplary, claims, losses, expenses, debts or damages of any nature whatsoever, including but not limited to, damages for loss of profits, loss of income, loss of revenues, loss of anticipated sales, loss of opportunities, business interruption, failure to realize unexpected savings, personal injury, damage to property, damages resulting from viruses, data corruption, failed messages, transmission errors or problems, links to third-party website/application, third-party content, third-party products or services, claims of third parties, loss of goodwill, use, data or other intangible losses (even if they have been advised of the possibility of such damages), whether resulting from faults, omissions or negligence of contractual or statutory nature or of any other nature whatsoever, resulting from: (i) your access or use or the inability to access or use the Website/Application, the Website/Application Content or the Third Party Content or any website to which you hyperlink from the Website/Application or any information or your reliance on any content, goods or services available on or through any linked website/application; (ii) any third party claims that the access or use by you of the Website/Application, the Website/Application Content or the Third Party Content violates any intellectual property or proprietary right; (iii) any failure of performance of the Website/Application, the Website/Application Content or any Third Party Content, whether related to error, omission, interruption, defect, delay in operation or transmission, computer viruses or line failure; or (iv) any other matters relating to the Website/Application, the Website/Application Content or the Third Party Content, even if you have been advised of the possibility of such damages, and whether resulting from any misrepresentation, tort or contract law or otherwise. 10. Indemnity and Discharge
You are responsible and liable for: (a) any breach of your representations, warranties, covenants or obligations under these Terms of Use and for the consequences of such breach, including any resulting loss or damage incurred by CIAS; (b) any and all activities that occur at the time of your age confirmation, registration or creation of your account; and (c) any and all actions and omissions by you.
You agree to indemnify and hold harmless CIAS, its affiliates and subsidiaries and their respective Representatives from and against any claims, losses, judgments, damages, costs and expenses (including, without limitation, reasonable legal fees), incurred by any of the foregoing parties due to or resulting from your use of the Website/Application, the Website/Application Content or the Third Party Content or your violation of these Terms of Use. You will assist and co-operate as reasonably required by the foregoing parties in the defense of any such claim or demand.
11. Changes to these Terms of Use
We reserve the right to change any of these Terms of Use at any time and at our sole discretion. Any changes will be effective upon posting of a new or modified version of these Terms of Use on the Website/Application. In some cases, we may also decide to send you a notice in other ways at our discretion, such as via email or other contact information you have provided, that the Terms of Use were changed. Your use of the Website/Application will be subject to the then current version of these Terms of Use or any other policy or guideline posted or referenced on the Website/Application at the time of such use. Your continued use of the Website/Application following the posting of any changes will constitute your acceptance of such changes or modifications. Applicable Law
These Terms of Use will be governed by the laws of the Province of Ontario and the applicable federal laws of Canada. Any dispute or legal proceedings arising directly or indirectly from these Terms of Use shall be instituted exclusively before a competent court of law located in the legal district of Toronto, Province of Ontario, Canada, and you irrevocably submit and consent to the exclusive jurisdiction of those courts in respect of all such disputes.

Our methods of communicating with you about your account and your use of the Website/Application will be by email or by SMS. By using the Website/Application, you agree that all communications related to your use of the Website/Application and any other related information may be provided to you electronically and, unless we choose otherwise, electronically only. Electronic communications with you will comply with Canada’s Anti-Spam Legislation
- Entire Agreement
These Terms of Use include and incorporate by reference all notices, policies, disclaimers and other terms and conditions contained on the Website/Application, including the Privacy Policy (collectively, the "Additional Terms"). These Terms of Use, as they may be amended from time to time, constitute the entire agreement between you and CIAS relating to the use of the Website/Application and supersede any prior understandings or agreements (whether oral or written), claims, representations, warranties, and understandings of the parties regarding the use of the Website/Application and these Terms of Use may not be amended or modified except in writing or by making such amendments or modifications available on the Website/Application. By using the Website/Application after the date on which any modifications enter effect, you agree to the latest version of these terms.
15. Assignment
You may not assign or otherwise transfer your rights, duties, or obligations hereunder. You acknowledge that CIAS has the right to assign this Agreement to a party who agrees to assume the responsibilities under these terms upon notice to you.
Severability
If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms of Use remain in full force and effect.
17. No Waiver
CIAS will not be considered to have waived any of its rights or remedies described in these Terms of Use unless the waiver is in writing and signed by CIAS. No delay or omission by us in exercising our rights or remedies will impair or be construed as a waiver. Any single or partial exercise of a right or remedy will not preclude further exercise of any other right or remedy. Any failure by us to enforce the strict performance of any provision of these Terms of Use will not constitute a waiver of our right to subsequently enforce such provision or any other provisions of these Terms of Use.
18. Termination
These Terms of Use are effective until terminated or replaced by us, with or without cause, in our sole and exclusive discretion. We may refuse to grant you access to the Website/Application if you fail to comply with any of our Terms of Use. We also reserve the right to terminate or suspend your use of the Website/Application or any portion thereof at any time, for any reason, with or without cause. Any such termination by us shall be in addition to, without prejudice, such rights and remedies as may be available to us, including injunction and other civil or equitable remedies or relief. If these Terms of Use or your permission to use this Website/Application are terminated for any reason, then (a) these Terms of Use will nevertheless continue to apply and be binding upon you in respect of your prior use of this Website/Application and anything connected with, relating to or arising from that use; and (b) we may continue to use and disclose your personal information in accordance with our Privacy Policy, as amended from time to time.

Privacy Policy
Canadian International AutoShow (“CIAS”, “our”, “we” or “us”), the operator of the autoshowplus.ca website/application and related mobile application (the “Application”), is committed to protecting any personal information which you may provide while using, or that may be obtained from your use of, the Application and related services. The purpose of this privacy policy (the “Policy”) is to: (i) inform you of our privacy practices and policies, including how and why your personal information is collected, how your personal information is used and with which parties we may share your personal information; and (ii) provide you with contact information should you have questions or concerns about our practices. This Policy is accessible via the Application and should be read in conjunction with our Terms and Conditions.
This Application is for use only by residents of Canada. By using the Application, you consent to the collection, storage, use, disclosure, and retention of your personal information in accordance with this Policy. If you do not agree with this Policy, you should not access or use the Application. For this Policy, “personal information” refers to any information relating to a physical person which can be used to identify them directly or indirectly.
Overview of Our Privacy Practices
Our privacy practices are summarized here. Under this Policy, CIAS:
- Requires that you confirm that you are the age of majority in your province of residence, or operating with the approval of your guardian who is age of majority in your province of residence.
- Collects data through your Application usage, your internet protocol (IP) address, the Application cookies and email web beacons;
- Collects non-identifiable information regarding Application users (such as the date and
time you accessed the website);
- May share this information with its authorized employees, agents, service providers and
legal representations, and may also share this information with third parties that we engage to provide products and services on our behalf.
- Except as set out in (d), does not share your personal information with third parties without your consent, unless authorized or required by law or as disclosed to you when the information is collected.
- Stores your personal information with our service providers’ servers; however, the third-
party service providers are only permitted to store your personal information, and are not
otherwise authorized to collect, use, or disclose your personal information, except in
accordance with the purposes set out in this Policy.
- Allows you to withdraw your consent to the collection, use and disclosure of your personal information at any time; and
- Mitigates the risk and impact of potential harms involved in the disclosure of personal information through the adoption of reasonable physical, electronic, and managerial procedures appropriate to the sensitivity of the data to safeguard the personal information you provide to us. Even with these measures, there is a residual risk of the loss of, unauthorized access to or unauthorized disclosure of your information which could result in financial or other harm to you.

- Personal Information Collected by CIAS
When you first access the Application, you will be asked to provide your name and email address, and to confirm that you are of the age of majority in your province of residence.
CIAS may also collect your Application usage data and your internet protocol (IP) address, and other similar information that you provide via the Application, including information collected through the use of cookies on your browser. Also, we may collect information relating to the emails that we send to you, such as when you open the email, using single pixel gifs (also called web beacons) or other tracking technologies.
We may also ask you to provide additional personal information as part of any surveys sent to you to optimize our Application and gain insight into your thoughts and impressions.
You should exercise discretion when disclosing your personal information to us and should not disclose sensitive or confidential information that you wish to remain private or that may require you to impose specific data security or data protection obligations on us.
- Non-Identifiable Information Automatically Collected
The Application may automatically collect certain non-identifiable information regarding Application users , such as the date and time you access the Application, the consent to the Terms and Conditions of the Application, the Internet address of the website from which you linked directly to the Application, the operating system you are using, the sections of the Application you visit, the Application pages read and images viewed, and the materials you download from the Application. CIAS may collect, use, transfer and disclose aggregated and/or non-personal information in accordance with this Policy and applicable law.
- Cookies and Web Beacons
The Application uses "cookies", a technology that installs information on a website user's computer to permit the Application to recognize future visits using that computer. Cookies enhance the convenience and use of the Application. For example, the information provided through cookies is used to recognize you as a previous user of the Application, to track your activity at the Application in order to respond to your needs, to offer personalized web page content and information for your use, and to otherwise facilitate your Application experience. You may choose to decline cookies if your browser permits, but doing so may affect your use of the Application and your ability to access certain features of the Application.
The emails that are sent to you may also include web beacons. Web beacons allow CIAS to collect information about when email recipients open the emails sent to them, what parts of the email they review, their IP address, browser or email client type and other similar details. Some of this information may be correlated with recipients’ email addresses. This information is used to review how recipients are responding to the emails sent to them.
- Purpose of Collection and Use of Your Personal Information
Personal information that you supply during registration or that is collected through your use of the Application or from the emails sent to you by CIAS is collected and used for the following purposes:
- To ensure that users of the Application and recipients of emails from CIAS are of the legal age in their province of residence.
- To enforce our Terms and Conditions and to comply with applicable laws and regulations.
- To administer the Application and to provide support for the services available through the Application and to manage the emails sent by CIAS.
- To protect CIAS and Application users against fraud.
- To contact you and to send you information about our products, our activities, programs, and events, unless and until you opt-out of receiving such information by contacting us at

- Disclosure of Personal Information
We will keep personal information that you provide to us private and will disclose such personal
information only in accordance with this Policy and applicable law. We may disclose your personal information for the following purposes:
- We do not sell, rent, or lease to third parties any personal information collected from you. We may disclose or share personal information with our authorized employees, agents, service providers, affiliated companies and legal representatives for the purposes described in this Policy. We may also share your personal information with third parties engaged to provide products and services on our behalf, to the extent necessary for them to complete their function. To the extent that any such entities have access to your information, contractual measures will be in place to ensure that personal information is kept confidential and is used only for the purposes for which It was disclosed. Our affiliated companies, potential partners and third-party service providers shall follow privacy practices no less protective of all users than our practices described in the Policy.
- We will not otherwise share your personal information with third parties without your consent, unless authorized or required by law or as disclosed to you when the information is collected. We may disclose your personal information to a government institution or agency: (i) that has asserted its lawful authority to obtain the information or where we have reasonable grounds to believe the information could be useful in the investigation of unlawful activity; (ii) to comply with a subpoena or warrant or an order made by a court, person or body with jurisdiction to compel the production of information or as required to comply with our reporting obligations under applicable law; (iii) to comply with court rules regarding the production of records and information; or (iv) to protect our rights and property.
- If CIAS is involved in the sale or transfer of some or all its business, we may disclose your personal information in connection with the transfer or sale. Assignees or successors of CIAS, or our business or assets, may use and disclose your personal information for similar purposes as those described in this Policy, in accordance with applicable law.
In addition, we can disclose your personal information if we have your consent, or as permitted by applicable privacy laws. If your personal information must be disclosed outside your jurisdiction of residence, we will do so in accordance with applicable laws, and ensure our external partners do the same. In such circumstances, governments, courts, law enforcement, or regulatory agencies of that jurisdiction may be able to obtain access to your personal information through the laws of the foreign jurisdiction. Whenever we engage a service provider, we require that its privacy and security standards adhere to this policy and applicable privacy legislation. By using the Application, you consent to such disclosure of your personal information outside your jurisdiction of residence.
- How Your Privacy is Protected
The personal information collected about you is retained in confidence and CIAS has adopted reasonable physical, electronic, and managerial procedures appropriate to the sensitivity of the data to safeguard the personal information you provide. We use different security techniques to protect collected data against unauthorized access and we take reasonable measures to limit access to this data to authorized employees and contractors who need to know that information to perform, develop or improve our services, and ensure that those authorized employees and contractors are aware of their responsibilities.
Please note that the safety and security of your information is also your responsibility. Your password is an essential tool to ensure the protection of your account. We advise you to create your password with a unique string of numbers, letters and unique special characters and not give it to anyone. If the security or use of your password is compromised, for any reason whatsoever, please notify us immediately and create a new password.
Notwithstanding these measures, no collection or transmission of information over the Internet or otherwise can be guaranteed to be 100% secure, and therefore the security of any such information cannot be warranted or guaranteed.
- Withdrawal of Consent and Deletion of Personal Information
You may withdraw your consent to the collection, use and disclosure of personal information about you and/or request its deletion at any time. To do this, please contact the Privacy Officer at the e-mail address listed in this Policy. Withdrawal of your consent to the collection, use and disclosure of personal information or deletion of your personal information may result in you being unable to continue use of the Application or services. We will explain the consequences of deletion at that time to assist you in your decision.
You can always unsubscribe from receiving promotional emails from us by simply clicking the “unsubscribe” link provided at the bottom of every promotional email from us. All promotional communications sent to you shall be done in accordance with Canada’s Anti-Spam Legislation.
- Verifying and Amending your Personal Information
Subject to certain exceptions prescribed by law, you will be given reasonable access to personal information we hold regarding you, and you may request that your personal information be corrected or updated. Please e-mail the Privacy Officer at the e-mail address listed in this Policy and we will assist you. You may be required to put your request in writing to confirm your request, and we may ask for specific information to confirm your identity. It is your responsibility to notify us of any changes to your personal information.
- Retention of Personal Information
Your personal information will be retained in compliance with our legal obligations, and only as long as necessary for the purposes for which it was collected, subject to applicable laws. Once your personal information is no longer required, we will delete or anonymize it in accordance with applicable laws.
- Storage and Location of Information
You agree, acknowledge and consent to the transfer and storage of all personal information collected or used via the Application to CIAS, where such information may be kept and may be accessed and used for any of the purposes set out in this Policy. Please note that information collected or used via the Application, when and where under our control will be subject to the legislation of Canada, including legislation regarding the safeguarding of certain personal information, and may be disclosed to judicial and/or administrative authorities of such jurisdiction, where required
by law.
Your personal information will be stored in servers located in Canada. We may store and process your personal information collected through the Application on the servers of our third-party service providers or, from time to time, in other locations outside Canada that the service providers deem necessary or convenient in order to provide the services including but not limited to the United States of America and Europe. As such, foreign governments, courts, law enforcement or regulatory agencies may be able to access your personal information under foreign laws. The third-party service providers are only permitted to store your personal information, and are not otherwise authorized to collect, use, or disclose your personal information, except in accordance with the purposes set out in this Policy.
You agree and acknowledge that you have been informed as to the location where your personal information is kept and may be accessed and used as set forth herein above and that you may consult your personal information or request changes to it/its deletion by making a request to CIAS by email at cias@autoshow.ca
- Privacy Policy Changes and Updates
This Policy is effective as of the last updated date above and may be revised at any time, without notice to you. CIAS may, however, choose to notify you of a change to this Policy, for example by announcing the change on the Application. Your continued use of the Application constitutes your consent to the contents of any updated policy.
When we make significant changes to this Policy, we will attempt to notify you directly of the changes by sending you an email informing you of the changes and will require your consent prior to the changes coming into effect. Significant changes include using your personal information for a new purpose not anticipated originally or a new disclosure of your personal information to a third party for a purpose other than processing that is integral to the delivery of a service.
